These terms govern your use of the Ace Digi Hub platform (“the Service”), operated by A. Esquire Infracon Private Limited under the Ace Digi Hub brand. By creating a workspace or using the Service you agree to them.
The Service
Ace Digi Hub provides tools for businesses to manage customer relationships, including a CRM, analytics, and optional AI features for WhatsApp messaging and voice calls. Some features require a paid subscription and are not available on a trial workspace.
Your account
- You must provide accurate information when creating a workspace.
- You are responsible for activity under your account and for your team members’ use of it.
- You must keep your sign-in credentials secure and tell us promptly of any unauthorised use.
Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages, or message anyone who has not given the consent required by WhatsApp’s own policies and by applicable law.
- Continue messaging anyone who has opted out.
- Send unlawful, deceptive, harassing, hateful or infringing content.
- Impersonate another person or business, or misrepresent your identity or affiliation.
- Clone or synthesise any person’s voice without that person’s explicit, documented consent.
- Attempt to breach or circumvent the Service’s security, access another workspace’s data, or interfere with its operation.
- Copy, reverse engineer, decompile or otherwise attempt to derive the Service’s source code, prompts, models, workflows or design.
- Access the Service or its interfaces by automated means (scraping, bots, or calling its APIs other than through the Service itself), or probe, scan or test it for vulnerabilities without our written permission.
- Use the Service, or anything learned from it, to build or help build a competing product; or share, resell or sublicense access to anyone outside your own business.
Where you send messages through WhatsApp, you are also bound by Meta’s WhatsApp Business Messaging Policy and Commerce Policy. We may suspend a workspace that puts our platform access at risk.
Our intellectual property
The Service — its software, source code, AI prompts and agent designs, workflows, interfaces, documentation and branding — is owned by A. Esquire Infracon Private Limited, which operates it under the Ace Digi Hub brand, and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own business while your workspace is active. No other right is granted, and nothing in these terms transfers ownership of any part of the Service to you. Feedback you give us may be used without obligation to you.
Your data and your customers’ data
You retain ownership of the data you put into the Service. You grant us the limited right to process it in order to provide the Service. You are responsible for having a lawful basis to collect and process your own customers’ data, and for telling them how you use it. Our handling of data is described in the Privacy Policy.
AI features
AI-generated replies, transcripts and summaries can be wrong. You are responsible for what is sent from your workspace, including messages generated automatically. Do not rely on AI output for legal, medical, financial or other professional advice to your customers without review.
Third-party services
The Service depends on third parties including Meta, Google and the vendors listed in the Privacy Policy. Interruptions or changes to those services may affect the Service, and are outside our control.
Fees
Paid plans are billed in advance for the period shown at purchase. Usage-based charges, where they apply, are deducted from your prepaid wallet as they are incurred, at the rates we set for the Service. Wallet recharges are advances for our own AceOS services, including AI and platform usage, and are not cash deposits or payments to third parties. GST is shown separately at checkout; only the service value becomes usable credit. Redeeming that same prepaid credit does not incur GST a second time. Any customer convenience fee is shown before payment. A downloadable GST invoice is issued after payment verification. WhatsApp messaging fees are charged to you by Meta directly, through your own WhatsApp Business account, and are not part of our charges. Prices are in Indian Rupees (INR). How plans are cancelled and when payments are refunded is set out in our Refunds & Cancellations policy.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate a workspace that breaches these terms, that creates legal or security risk, or for non-payment. On termination we delete workspace data as described in the Privacy Policy.
Disclaimer and liability
The Service is provided “as is”, without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Ace Digi Hub is not liable for indirect, incidental or consequential losses, or for lost profits or data; and our total liability for any claim is limited to the fees you paid for the Service in the three months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.
Changes
We may update these terms. Material changes will be notified to account holders, and the date at the top will change. Continuing to use the Service after that means you accept the updated terms.
